Terms of service
Section 1 Scope and provider
(1) The following general terms and conditions, in the version valid at the time of the order, apply to all orders placed through our online shop.
(2) The provider and contracting party is: Sabine Lindner / Hundessa, Haringstraße 11, 85635 Höhenkirchen-Siegertsbrunn, Germany, email: hundessa@web.de, phone: +49 152 01366025 (hereinafter "we" / "seller").
(3) Our offer is directed at consumers and businesses. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (section 13 of the German Civil Code, BGB). A business is a natural or legal person or a partnership with legal capacity that acts in the exercise of its trade, business or profession when entering into the legal transaction (section 14 BGB).
Section 2 Conclusion of the contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
(2) By clicking the button with which you complete the order process subject to payment, you make a binding offer to purchase the goods contained in your basket.
(3) We accept your offer with the order confirmation that we send you by email immediately after you complete the order process. The contract is concluded when this email reaches you. As our made-to-measure items go into production immediately afterwards, the conclusion of the contract is also the start of manufacture.
(4) If no contract comes about, we will refund any payments already made without undue delay.
Section 3 Prices, value added tax and shipping costs
(1) All prices stated are final prices. As a small business within the meaning of section 19 of the German VAT Act (UStG), our turnover is exempt from value added tax; we therefore do not show it separately.
(2) Shipping costs are charged in addition to the prices stated. They amount to €5.99 for deliveries to Germany, €10.00 each to the Netherlands and Czechia, and €10.00 to Switzerland. The shipping costs are shown to you separately once more during the order process before you place your order. Further details can be found in our shipping policy.
(3) For deliveries to countries outside the European Union (in particular Switzerland), import charges of the country of destination apply in addition, namely import turnover tax or import VAT, customs duties where applicable, and the customs clearance and handling fees of the transport provider. These charges are not included in the purchase price and not in the shipping costs. They are not levied by us; as the recipient you pay them directly to the competent authorities or to the transport provider, usually on delivery of the shipment.
Section 4 Payment
(1) The following payment methods are available: credit and debit card via Shopify Payments, and PayPal. Which payment methods are available to you in an individual case is shown during the order process before you place your order. No additional costs arise from using the payment methods offered.
(2) Payment is made directly as part of the order process.
Section 5 Delivery
(1) Delivery is made to the delivery address you provide. We deliver to Germany, the Netherlands, Czechia and Switzerland. We do not currently deliver to other countries.
(2) Dog apparel, harnesses and collars are made to measure and are only manufactured after conclusion of the contract and according to the measurements you provide (made to order). The production time is 5 to 10 working days from conclusion of the contract. In the months of October to February it is up to 20 working days from conclusion of the contract.
(3) Leashes and gift cards are not made to individual measurements; the production time under paragraph 2 does not apply to them.
(4) In addition to the production time there is the shipping duration from handover to the shipping provider. It is 2 to 4 working days to Germany, 4 to 8 working days to the Netherlands and Czechia, and 5 to 8 working days to Switzerland.

(6) Working days within the meaning of these terms are Monday to Friday, excluding public holidays at the seller’s place of business.
Section 6 Retention of title
The delivered goods remain our property until payment has been made in full.
Section 7 Warranty / liability for defects
The statutory provisions on liability for defects apply (sections 434 et seq. BGB).
Section 8 Right of withdrawal / exclusion for made-to-measure items
(1) Dog apparel, harnesses and collars are not prefabricated; they are made according to the consumer's individual choice or specification and to the measurements provided by the consumer (made to measure). For these goods, the statutory right of withdrawal is excluded pursuant to section 312g(2)(1) BGB.
(2) For leashes and gift cards, consumers have a statutory right of withdrawal of fourteen days. You will find the full withdrawal instructions and the model withdrawal form in our return and withdrawal policy.
(3) To declare your withdrawal, the button "Vertrag widerrufen" ("withdraw from contract") is additionally available in our online shop. We will confirm receipt of your declaration of withdrawal without undue delay on a durable medium.
(4) Details of the exclusion, of the withdrawal instructions and of our voluntary goodwill arrangement for made-to-measure items can be found in our return and withdrawal policy.
Section 9 Contract text, contract language and input errors
(1) We store the contract text and send you the order details by email without undue delay after completion of the order. You can access these general terms and conditions on this page at any time and print or save them. If you have a customer account, you can view your orders there.
(2) The contract is concluded in German or English, depending on the language in which you carry out the order process.
(3) Before placing your order you can change your entries at any time using the usual keyboard and mouse functions. In the final order overview your details are shown to you once more; there you can go back, correct entries or cancel the order process.
Section 10 Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
Section 11 Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not restrict mandatory consumer protection provisions of the state in which the consumer has their habitual residence.
